The Rivne District Administrative Court has ruled in favor of the district prosecutor’s office, declaring the city council’s decision regarding the sale of the land plot illegal.

It is noted that the Rivne City Council planned to auction a land plot of approximately 0.2 hectares for about 1.7 million UAH, located on Vesnyana Street. This plot was intended for the construction of tourist infrastructure facilities and public catering establishments.
However, there is a pond on this territory, making it impossible to transfer it into private ownership in accordance with water and land legislation.
According to Article 6 of the Water Code of Ukraine, water bodies are the property of the Ukrainian people and can only be granted for use.
The prosecutor’s office, responding to this violation, filed a lawsuit. As a result, it was possible to preserve the water body and prevent its removal from community ownership.
