Court in Rivne to Consider Case of Illegal Border Crossing

Law enforcement officials have established that between 2022 and 2023, a 39-year-old resident of Rivne and a 26-year-old woman from Zaporizhzhia, who was living in the regional center at that time, conspired with a 26-year-old woman from Rivne to create two charitable organizations, which they registered as legal entities by producing stamps.

Knowing full well that eight citizens had no legal grounds for leaving Ukraine, they submitted knowingly false information in initiative letters to the “Shlyakh” system regarding trips abroad as volunteers to receive humanitarian aid.

Subsequently, the 39-year-old suspect involved a 56-year-old resident of Zdolbuniv, who is the vice president of one of the charitable foundations in the Republic of Poland. Together, they smuggled five men who were subject to military service across the border.

None of the 13 citizens returned to the country.

The investigator from the operational support department of the strategic investigations unit, under the procedural guidance of the Rivne regional prosecutor’s office, informed four perpetrators of their suspicion of committing a crime under part 2 of Article 332 of the Criminal Code of Ukraine (organizing illegal transportation of individuals across the state border of Ukraine, assisting in its commission through advice, instructions, and removing obstacles, committed against several individuals by a group of persons in conspiracy).

The court chose preventive measures for the 39-year-old, the 26-year-old suspects, and the 56-year-old in the form of detention with the possibility of bail, which they posted, while the 26-year-old female suspect was also granted bail. However, later the preventive measure for the 39-year-old man and the two women was changed to personal obligation.

The investigator has completed the pre-trial investigation: the materials of the criminal proceedings have been sent to court.

The penalty under the article provides for imprisonment from 5 to 7 years.
