In Rivne Region, the right of communal ownership to 5 hectares of land has been revoked

The Economic Court of Rivne Region granted the prosecutors’ claim and revoked the right of communal ownership to a land plot of over 5 hectares.

During the investigation, it was established that in 2020, the State Geocadastre Office, following a land inventory, classified agricultural lands as objects of civil rights and transferred them from state to communal ownership.

Subsequently, the Zarichne community registered the right of communal ownership to these lands, entering the relevant data into the State Register of Property Rights to Real Estate.

However, it was not taken into account that one of the plots partially belongs to state-owned forestry land and is under the permanent use of the State Enterprise “Forests of Ukraine.”

Violation of the rights of the legitimate owner

Thus, the intended purpose of the forestry land, which is subject to enhanced protection with special usage conditions, was unlawfully changed. They were removed from limited circulation and the permanent use of the state enterprise.

In order to restore the rights of the legitimate owner to the land, the prosecutor filed a lawsuit in court.

Court Decision

The Economic Court of Rivne Region agreed with the prosecutor’s arguments, revoking the state registration of the disputed land plot.
