Compensation for Burned Equipment
In conditions where energy companies are operating under immense strain due to Russian shelling, consumers have the right to compensation for burned equipment in cases of non-compliance with electricity quality parameters, particularly for unstable voltage. This opportunity is established by guaranteed quality standards for electricity supply.
Damage to electronic devices is influenced by sharp voltage spikes during power activation, instability in electricity quality, as well as faults in lines or transformers. The distribution system operator (DSO) is responsible for ensuring the proper technical condition of networks and compliance with electricity quality standards.
However, compensation for burned equipment is not automatic. It is considered as reimbursement for losses related to non-compliance with standards. It is necessary to prove that the cause of the damage lies specifically in the quality of electricity supply, rather than in a technical malfunction of the device.
Amount of Compensation
The amount of compensation is determined based on the type of violation of electricity supply standards and the consumer class. The minimum compensation amount is 200 UAH for residential consumers, 400 UAH for small businesses, and 600 UAH for non-residential consumers. The amount may increase depending on the duration and volume of electricity consumption affected by the violations. These standards are mandatory for all distribution system operators and electricity suppliers in Ukraine.
The energy company is responsible for providing poor quality service and is obliged to compensate for losses from burned equipment by returning the cost of repairs or the full market value of the device if it cannot be repaired.
In the event of equipment failure, the consumer should first contact the electricity supplier with a written statement describing the situation, listing the damaged equipment, and specifying the desired amount of compensation.
It is also recommended to include documents that confirm the extent of the damage, such as receipts, invoices, or service center reports. Additionally, it is advisable to request a representative from the electricity supplier or network operator to draft a claim report for voluntary compensation for the damaged equipment. The report should contain information about the inadequate quality of electricity supply. The electricity supplier is required to resolve the issue regarding the claim within 5 working days or provide a written justification for refusal.
