The Rivne Court of Appeal granted the appeal of the Rivne Regional Prosecutor’s Office, overturning the previous decision of the first instance court and upholding the prosecutor’s claim.

It was established that in 2022, one of the residents of Radyvyliv was granted a lease for a land plot on which he set up a repair workshop with an area of 22.1 sq. m.
This property became the basis for the purchase of the land plot without conducting land auctions.
However, the area of the alienated plot is nearly 200 times larger than the area of the workshop. Moreover, the land was actually transferred into private ownership not for servicing the workshop, but for the new construction of a garage with a total area of almost 500 sq. m, which violates legal requirements and does not serve the public interest.
In this regard, the prosecutor’s office filed a lawsuit to declare the sales contract invalid and to return the land plot. The district court dismissed the claims, but the Rivne Court of Appeal supported the prosecutor’s position, upheld the claim, and ordered the return of the land plot worth 1.5 million UAH to the Radyvyliv territorial community.
